criminal law, the crime against the property, which is consisted in the requirement of the transfer of property (or right to the property) under the threat of violence above the person, in the conducting either under the protection of whom find this property, or above its close ones, and also under the threat of proclaiming the pozoryashchikh information about them or destructions of their property. As the close persons in this case are considered not only relatives, but also other citizens, the threat of the application of violence to which can have the appropriate effect on the owner of property. On the Soviet right is provided penal responsibility for v. State or public properties, and also personal effects of citizens (article 95, 148 u to THE RSFSR and the corresponding articles UK of other union republics). In the Kirghiz, uzb and ukr of SSR the composition of crime v. is not provided.

In contrast to such compositions of crime as robbery and robbery, with v. the threat of the application of violence is directed toward the coercion of the transfer of property guilty, but not to overcoming of the resistance of victim; therefore in the case of the realization of threat (i.e. the application of violence), and then of zavladeniya by property, the guilty bears responsibility on the totality: for v. and for the robbery or the robbery (depending on the nature of the used violence).
